Ferdinand Waititu, Wife Susan Wangari Face Fresh Legal Setback in Corruption Case

The Milimani Anti-Corruption High Court has cancelled the bond terms granted to former Kiambu Governor Ferdinand Waititu and co-convict Luka Mwangi Wahinya in a Ksh588,749,000 corruption case, ordering their immediate remand.

Delivering judgment on Wednesday, October 14, 2026, High Court Judge Rose Ougo ordered Waititu and Wahinya remanded at Nairobi Remand Prison after upholding their convictions by the Milimani Anti-Corruption Chief Magistrate’s Court.

Judge Ougo ruled that the Director of Public Prosecutions (DPP) proved beyond reasonable doubt that the appellants unlawfully participated in the irregular procurement of a multi-million-shilling road tender in Kiambu County.

Dismissing the appeals filed by Waititu, Charles Chege, and Wahinya, the High Court affirmed that the convictions, sentences, and mandatory statutory fines imposed by the trial court were lawful and properly executed under the Anti-Corruption and Economic Crimes Act.

“The first appellant and the third appellant have been out on bond; they are both hereby cancelled, and they shall be remanded at Nairobi Remand Prison,” Judge Ougo ruled.

Acquittals Set Aside on Money Laundering Charges

In a major legal turn, the High Court allowed the State’s cross-appeal against the prior acquittal of Waititu, his wife Susan Wangari, and two co-accused on money laundering charges.

Justice Ougo set aside the lower court’s acquittals, ordering Wangari remanded at Lang’ata Women’s Prison.

Because the High Court was not exercising original jurisdiction regarding sentencing on the money laundering counts, Justice Ougo referred the matter back to the trial court.

All four individuals are scheduled to appear before Milimani Anti-Corruption Chief Magistrate Harrison Barasa on Monday, October 19, 2026, for mitigation and sentencing on the money laundering convictions.
